Assault is an assault committed in circumstances of a sexual
nature such that the sexual integrity of the victim is
violated. No consent is obtained where:

the consent is obtained
by the application of force, threats or fraud; the agreement to the
sexual activity is expressed by someone other than the complainant;
the complainant is incapable of consenting to sexual activity; the
accused induces the complainant to engage in the sexual activity by abusing
a position of trust, power or authority; the complainant expresses
by words or conduct a lack of agreement to engage in the activity;
- the complainant has expressed
consent to engage in the sexual activity but then withdraws that
consent by words or conduct.
