Driving Offences
These charges can be commenced under the Criminal Code:
- Dangerous Driving Charges;
- Failure to Stop at the Scene of an Accident; and
- Impaired Driving Causing Death or Bodily Harm.
They can also arise under the Motor Vehicle Act, Careless Driving provision and include:
- Driving without Due Care and Attention;
- Driving without reasonable consideration for other persons using the highway; or
- Driving at a speed that is excessive relative to the road, traffic, visibility or weather conditions.
Alternatively such driving charges can be commenced under the more serious Criminal Code provisions but be reduced to Careless Driving after plea bargaining discussions with the Crown.
